Costa Rican Citizenship: Requirements, Family Routes and Rights

Costa Rican citizenship and legal residency are separate procedures. DGME handles immigration status; the Civil Registry within the Tribunal Supremo de Elecciones (TSE) handles nationality applications. Start by identifying the citizenship route that fits your circumstances rather than assuming every applicant follows the same residence period.

Five or seven years for naturalization by residence

The TSE residence-route checklist specifies five years of official residence for Central Americans, Ibero-Americans and Spaniards by birth, and seven years for other nationalities. The five-year distinction is not a general rule for spouses or children of Costa Ricans.

Ask TSE to assess your nationality and residence history, including the records and absences relevant to the calculation. Time since your first holiday is not a reliable substitute for the official calculation. Reaching a qualifying period does not automatically grant citizenship.

Marriage and parentage have separate routes

The marriage procedure requires two years of marriage to a Costa Rican and the required presence in Costa Rica over that period, with the marriage registered in Costa Rica. Read our marriage-naturalization guide rather than applying the residence-route checklist without checking.

For a Costa Rican parent or a birth in Costa Rica, check the applicable registration, option or naturalization procedure. Age, place of birth and the parent’s nationality history matter. Our parentage guide explains why a family connection alone is not the complete answer.

Prepare the residence-route evidence

The official checklist addresses the initial application and notification details, accepted identity documents, birth certificate, witness evidence, means of support, assessment evidence, criminal records, photograph and declarations. Use the full checklist for your own situation and the exact form of each document.

Do not substitute a DGME residency checklist for TSE’s nationality requirements. For example, the residence-naturalization checklist specifies accepted immigration identity documents and states that a passport is not valid for that particular identity item.

Criminal-record evidence

TSE’s residence-route checklist calls for a criminal-record certificate from the country of origin or the last foreign country of residence where applicable. It specifies a federal or national authority and presentation within three months of issue, together with the required authentication and official Spanish translation when needed.

If a record contains an entry, obtain advice about the exact proceeding and applicable rules. Do not conceal information or assume that a certificate issued for another procedure has the necessary scope. TSE also evaluates conduct requirements under the naturalization rules.

Spanish, history and values

MEP administers the naturalization examinations. Its current program identifies Spanish Language and History and Values of Costa Rica, with a passing score of 70 in each test. The TSE checklist also addresses recognized studies and specified exemptions.

Confirm which evidence applies to your route before paying for a course or test. Use our official study-material guide for the MEP program and current notices. An informal conversation in Spanish does not replace required assessment evidence.

Document dates and authentication

Read each checklist’s own validity provisions. The residence-route and marriage-route documents should not be treated as interchangeable, and a universal six-month rule should not be applied to all records. Confirm the issuing authority, authentication chain, translation and timing before placing an order.

Keep a checklist showing what you have, what needs clarification and what must be requested. Retain source documents, copies and receipts together. If an official asks for additional evidence, follow the actual notice and its deadline.

Processing and other nationality consequences

Separate the time needed to become eligible, document preparation and the authority’s processing of the application. A private estimate is not an approval date. Check your case through the responsible authority and retain notification records.

Before signing nationality declarations, check both Costa Rican requirements and the effect under your other country’s law. Our dual-nationality guide discusses this distinction. Do not assume that a residency investment purchases citizenship or replaces TSE’s nationality procedure.

Children born in Costa Rica: registration and nationality

A birth certificate, an immigration card and recognition of Costa Rican nationality answer different questions. For a child born in Costa Rica to foreign parents, the Constitution provides an option to register as Costa Rican through a parent during minority, or through the person’s own decision before turning 25. A child born abroad to a Costa Rican parent by birth has a related constitutional route. These are not the ordinary five- or seven-year residence applications. See Constitution, Article 13.

TSE’s option-of-nationality checklist says the birth must already be registered in Costa Rica before the option can be approved. Start by checking the actual civil registration and the child’s age. Record the parents’ nationality at the relevant time and whether a Costa Rican parent acquired nationality by birth or naturalization. Ask the Civil Registry to identify the correct route when a birthday deadline is approaching.

Do not assume a parent’s residence card automatically settles the child’s nationality, or that citizenship paperwork for the child automatically changes either parent’s immigration status. Keep the child’s registration documents and the parents’ immigration files separately organized. For broader questions about parental responsibility, adoption or a child’s protection, obtain advice about that specific issue rather than treating a nationality application as the answer to every family-law question.

Newborn children of foreign residents: which route comes first?

If the child was born in Costa Rica to foreign parents, first check the Costa Rican birth registration and whether the parents will exercise the child’s nationality option described above. Do not apply an adult residency checklist to that newborn or assume a foreign birth certificate is required for a Costa Rican birth. The parents’ DIMEX cards do not themselves decide the child’s nationality.

If the child is to remain a foreign national, or was born outside Costa Rica, ask DGME to identify the appropriate immigration category based on the child’s birthplace and nationality, the parents’ approved categories and the family relationship. Obtain the child-specific checklist; do not simply reuse a parent’s criminal-record, fee or consular-registration list. Keep the Civil Registry’s nationality decision separate from any DGME residence application. This guide does not claim that every newborn automatically receives the same status as a parent.

Citizenship following adoption

Age and civil registration matter in adoption cases. TSE publishes a separate adoption-registration checklist. For a foreign adoptee it addresses the complete foreign birth certificate, authentication or apostille, and official Spanish translation when applicable. An adoptee over 18 must ratify the wish to be registered as Costa Rican. The checklist says foreign persons over 25 adopted by Costa Ricans must subsequently follow the relevant naturalization procedure if they want Costa Rican nationality.

Before ordering documents, send the Civil Registry the adoption decision’s country and date, the adoptee’s date of birth and the adoptive parents’ nationality details. Ask which registration or nationality procedure applies to that combination. Do not infer an automatic passport entitlement from an adoption agreement alone. Keep certified decisions, registration confirmations and any later nationality resolution together, including evidence that foreign decisions have been recognized where required.

Nationality, political rights and civic duties

The Constitution distinguishes nationality from the political rights and duties of adult citizens. Article 90 concerns Costa Ricans over 18; Article 18 sets out duties to observe the Constitution and laws and contribute to public expenses. Article 94 includes a twelve-month period after naturalization before a naturalized citizen can vote. Check the electoral register and TSE instructions before an election. Citizenship is not an exemption from ordinary legal obligations. See the constitutional text.

When assessing what nationality would change for you, make separate lists for voting, travel documents, employment and your other country’s rules. A residence approval, a nationality resolution and a passport application should not be used interchangeably. Keep the final documents so institutions can verify the status relevant to the service you request.

Can a naturalized citizen apply for government jobs?

Citizenship does not guarantee a public-sector job or make every post’s eligibility rules identical. DGSC’s 2024 legal guidance explains the importance of the relevant minimum qualifications and demonstrated suitability. Its current vacancies portal lists positions by class and specialty, with qualifications, experience and application deadlines.

Choose an actual vacancy, read its complete requirements and ask the recruiting institution about any nationality condition. Compare your education and experience against the named job class; check recognition of foreign qualifications and professional registration separately. Use the DGSC applicant-registration page when the vacancy directs you there. Other institutions may operate their own competitions, so an application in one system should not be assumed to cover every public employer.

Elected office has separate rules from ordinary government employment. For example, Constitution Article 108 requires a naturalized candidate for deputy to have ten years of residence after obtaining nationality. That condition should not be copied into an article as a universal waiting period for all government jobs.

Renouncing Costa Rican nationality

It is misleading to say that no renunciation procedure exists. Although Article 16 uses language protecting Costa Rican nationality from loss and renunciation, TSE publishes an actual renunciation checklist citing constitutional case law. The checklist covers Costa Ricans by birth and naturalization.

It calls for an initial application, notification details and qualifying evidence concerning another nationality. The stated alternatives include an authenticated or apostilled foreign-authority document proving that nationality, an appropriately certified foreign passport copy, or a foreign-authority document showing a new nationality is being processed. Official Spanish translation applies where required. Read the full checklist for the exact evidence and validity rules, and use TSE’s sample initial statement only after the applicable consequences have been explained.

This is a significant nationality decision. Before filing, obtain advice about how the timing affects your other nationality, identity documents, ability to reside in Costa Rica and family circumstances. A privately signed declaration alone is not a substitute for completing the authority’s procedure. Request confirmation of the outcome and keep it with your nationality records.

What nationality does a child born on an aircraft have?

There is no universal rule that the baby receives the airline’s nationality or the nationality of the flight’s destination. A case can involve the parents’ nationality, the place and airspace of the birth, the aircraft’s registration and the laws of the countries concerned. For a Costa Rican claim, start with Article 13 of the Constitution and ask the Civil Registry to assess the documented facts.

The U.S. State Department’s Foreign Affairs Manual, sections 301.1-5 and 301.1-6, illustrates why location matters: its U.S. guidance distinguishes births in U.S. airspace from births outside that territory and discusses evidence from an aircraft or medical log. This is U.S. guidance, not a Costa Rican nationality rule.

Ask the airline and attending medical personnel for a record of the birth’s time and location, and retain the parents’ identity and nationality evidence. Contact the civil-registration authority and relevant consulate about birth registration and travel documentation before arranging onward travel. Do not treat an airline certificate or an unverified story about free flights as a nationality decision.

Obtaining a Costa Rican passport after nationality is established

A Costa Rican passport application is separate from obtaining residency or nationality. Once the relevant nationality and identity records are in order, use DGME’s official passport instructions or an authorized service channel. Banco de Costa Rica’s Punto País page provides passport appointments and links to requirements by transaction type.

BCR states that appointment booking is free, while the passport transaction has a separate charge. Its general passport instructions require valid physical identification and payment at the appointment. Consult the detailed requirements for an adult, minor, renewal or replacement rather than assuming they are identical. Confirm the current amount and delivery arrangements when booking; do not buy non-refundable travel on the strength of a processing estimate.

For a minor, establish the required parents’ or representatives’ attendance and identity evidence before the appointment. Explain any death, absence or court order to the issuing authority so it can identify the correct procedure. If you are outside Costa Rica, use the competent Costa Rican consulate’s instructions instead of assuming a domestic bank appointment can be completed overseas.
